A Hertfordshire Constabulary officer is facing a disciplinary hearing after judges claimed she was “determined to mislead us” when appearing in court as a witness.
PS Fahamida Miah is alleged to have given evidence that was “obviously false” when appearing off-duty during an appeal hearing in October 2020, which related to her previous role at a lettings agency.
According to a notice on the police force’s website, the Crown Prosecution Service said the judge’s findings against the officer amount to an Adverse Judicial Finding, which could negatively affect her credibility as a witness in future judicial cases.
A hearing on Thursday, February 24 will determine whether PC Miah’s conduct breached the professional standards in relation to honesty and integrity, orders and instructions, and discreditable conduct, or failed to abide by the Crown Court oath.
The hearing will decide whether the conduct could bring the police service into disrepute or constitutes gross misconduct, which could result in dismissal.
The full notice which outlines the allegations against the officer said: “On 13 October 2020, whilst off duty, Ms Miah gave witness evidence in a personal capacity at an appeal hearing at Luton Crown Court.
“The hearing related to Ms Miah’s former occupation as a lettings assistant/manager at a lettings agency. Ms Miah was financially connected to the appellant because she jointly owned property with him.
“Ms Miah gave evidence that; she dealt with most administrative things at the company; she had no knowledge of certain properties being rented out as Homes in Multiple Occupation; evidential Gumtree adverts related to other addresses and not those central to the case; and that no connection remained between herself and the letting agency.
“The appeal Justices found that Ms Miah was “…a poor witness, an unconvincing witness determined to mislead us.”. Some of Ms Miah’s evidence was described as “…unconvincing…artificial and obviously false…since she is a police officer we are particularly concerned about the misleading evidence that she gave to us”.
“The Crown Prosecution Service have determined that the Judge’s findings against Ms Miah amount to an Adverse Judicial Finding, this is likely to negatively affect her credibility as a witness in any future judicial cases.
“These matters amount to breaches of; Honesty & Integrity; Orders & Instructions; and Discreditable Conduct. Ms Miah is alleged to have failed to abide by the Crown Court oath, Police Regulations and the Standards of Professional Behaviour, and has behaved in a dishonest manner and without integrity which would likely bring the police service into disrepute and damage the public trust and confidence in the police.”
The misconduct hearing will take place in public at Hertfordshire Constabulary’s headquarters in Welwyn Garden City at 9am on Thursday, February 24.
The hearing’s chair is then expected to publish a decision online once the proceedings have concluded.
